Gentletrip Terms and Conditions for the purchase and sale of goods
- Definitions
- Personal data - any information relating to an identified or identifiable natural person (data subject); an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, a personal identification number, location data and an online identifier, or to one or more factors specific to the natural person's physical, physiological, genetic, mental, economic, cultural or social identity.
- Gentletrip - the website located at www.gentletrip.lt, where the Sellers' goods are sold and which is administered by the private legal entity MB OnisCo, registered in the Vilnius Branch of the Register of Legal Entities of the Republic of Lithuania, registered in the Vilnius Branch of the Register of Legal Entities, legal entity code 306120657, registered office address Totorių g. 13, LT-01121 Vilnius. "Gentletrip" in these Terms and Conditions is also understood as the Seller in relation to the goods sold by it.
- Seller - The legal entity whose goods are sold on www.gentletrip.lt in accordance with these Terms and Conditions and who is responsible for the execution of the order placed by the Buyer shall be indicated in the order for goods. The details of the Seller with whom the contract for the sale of the relevant Goods is concluded in accordance with these Terms and Conditions shall be specified in the Goods Order.
- Account - The result of the Customer's use of www.gentletrip.lt as a result of registering with Gentletrip on the basis of the Terms and Conditions, which results in the creation of a personal account for the Customer that stores his/her personal data and order history.
- Buyer - (1) a natural person with legal capacity, i.e. a person who has reached the age of majority and whose legal capacity is not limited by a court order; (2) a legal person.
- Privacy policy - A document approved by Gentletrip that sets out the basic rules for the collection, aggregation, processing and storage of Personal Data when using Gentletrip.
- Agreement - A contract of sale of the relevant Goods shall be concluded between the Buyer and the Seller and shall be deemed to have been concluded from the moment the Order is placed. The terms of each Contract entered into between the Buyer and the Seller shall be deemed to be identical to the terms of the Regulations in force at the time of the placing of the Order, and such Contracts shall always be enforceable by the parties in accordance with the Regulations in force at the time of the placing of the Order.
- Parties - Buyer and Seller together.
- Rules - these "Gentletrip Terms and Conditions of Sale and Purchase", which shall apply to each and every purchase made by the Buyer on Gentletrip and to each and every Sale and Purchase Agreement concluded between the Buyer and the Seller.
- Order - An order for Goods specifying the Goods the Buyer wishes to purchase from the Seller shall be specified in the same order.
- General provisions
- The Buyer confirms the Terms and Conditions by reading them and by ticking the box next to the statement "I have read and accept the Gentletrip Terms and Conditions". The Terms and Conditions thus approved shall constitute a binding legal document for the Parties, setting out the rights and obligations of the Buyer and the Seller, the conditions for the purchase of the goods and payment for them, the procedure for the delivery and return of the goods, the liability of the Parties, and any other terms and conditions relating to the purchase and sale of goods at Gentletrip.
- By creating an account on Gentletrip, the Customer accepts the Terms and Conditions at the time of the first registration. Once the Buyer has approved the Terms at the time of first registration (account creation), the Terms shall apply to all purchases made by the Buyer until the updated Terms are published on www.gentletrip.lt. Once updated, the Rules shall apply from the moment of their publication on www.gentletrip.lt and the Buyer shall be informed of the update of the Rules in accordance with the procedure set out in Clause 2.4 of the Rules.
- Only Purchasers as defined in Clause 1.5 of the Terms and Conditions are entitled to purchase Gentletrip. By accepting the Terms and Conditions and having read the Privacy Policy (clause 2.4 of the Terms and Conditions) and the Gentletrip Terms of Use, the Customer confirms that he/she has the right to purchase goods from Gentletrip.
- In the event of changes in market conditions or in the circumstances provided for by the legislation of the Republic of Lithuania, Gentletrip shall have the right to change, amend or supplement the Terms and Conditions. The Customer will be informed of this by logging into the Account or www.gentletrip.lt or by creating a shopping cart, but in all cases, after the update of the Terms and Conditions, the Customer may only place an order if he/she is familiar with and accepts the new version of the Terms and Conditions.
- The Buyer is obliged to familiarize himself with the Privacy Policy approved by Gentletrip and made publicly available.
- If the Seller has the right or obligation to provide the Buyer with information or documents by e-mail, it shall in all cases be the Buyer's responsibility to provide the Seller with a valid e-mail address belonging to the Buyer.
- Ordering the goods – the moment when the legal relationship of sale and purchase is established
- The Buyer can order goods from Gentletrip in one of the following ways:
- by registering online on Gentletrip (by entering your registration name and password);
- online without registering on Gentletrip;
- When ordering goods by one of the methods specified in Clauses 3.1.1 - 3.1.2 of the Terms and Conditions, the Buyer is obliged to specify his/her Personal Data, which are necessary for the proper fulfilment of the order, in the relevant fields of the information provided in the system, which shall be processed in accordance with the procedure stipulated in the Privacy Policy of the Gentletrip.
- When the Buyer, having selected the goods or services to be purchased and having formed a shopping cart, has completed all the steps of the order, the last of which is the selection and confirmation of the method of payment, it shall be deemed that a legal relationship of sale and purchase has been established and that a contract of sale has been concluded between the Seller and the Buyer. The Buyer shall be informed of the confirmation of the order by means of a notification to the e-mail address indicated by the Buyer. The Seller shall send to the Buyer a link to the applicable Regulations together with the confirmation of the order to the e-mail address indicated by the Buyer.
- The instructions for the goods ordered by the Buyer shall be provided in Lithuanian no later than at the time of delivery of the goods to the e-mail address specified by the Buyer. All essential information about the product and its features is contained in the Seller's product description "Gentletrip".
- Each Buyer's order shall be stored in Gentletrip's and the Seller's database in accordance with their respective privacy policies.
- The Buyer can order goods from Gentletrip in one of the following ways:
- Buyer's rights
- The Customer shall have the right to purchase goods and order services on Gentletrip in accordance with these Terms and Conditions.
- The Buyer shall have the right to cancel the order in accordance with the procedure set out in these Terms and Conditions.
- The Buyer shall have the right to withdraw from the Contract in accordance with the procedures set out in these Conditions.
- The Buyer has the right to exchange or return the purchased goods in accordance with the procedure set out in the Regulations.
- The Buyer shall have other rights set out in these Terms and Conditions, the Privacy Policy, the Gentletrip Terms of Use and the legislation of the Republic of Lithuania.
- Buyer's commitments
- The Buyer, using Gentletrip, is obliged to fulfill his/her obligations, to comply with these Terms and Conditions, the Privacy Policy, the Gentletrip Terms and Conditions of Use, and other terms and conditions explicitly stated in the Gentletrip, as well as to abide by the legislation of the Republic of Lithuania.
- The Buyer shall pay for and accept the goods or services ordered in accordance with these Terms and Conditions.
- Seller's rights
- The Seller shall have the right to cancel the Buyer's order without prior notice if the Buyer fails to pay for the Goods within 3 (three) working days after selecting the methods of payment provided for in Clauses 8.2.1 or 8.2.2.2 of the Conditions.
- Seller's commitments
- The Seller undertakes to execute the Buyer's orders in accordance with the procedures set out in these Terms and Conditions and to communicate with the Buyer by means of the Gentletrip website or by means of the Buyer's contact details specified by the Buyer.
- The Seller undertakes to provide the Buyer with the information set out in Article 6.228-7 of the Civil Code of the Republic of Lithuania in a clear and comprehensible manner in the Gentletrip system.
- The Seller undertakes to respect the Buyer's privacy and to process the Buyer's Personal Data only in accordance with the procedures set out in the Terms and Conditions, the Privacy Policy, the Gentletrip Terms of Use and the legal acts of the Republic of Lithuania and the European Union.
- Gentletrip undertakes to inform the Customer prior to the placing of the order of the suspension or termination of Gentletrip functions relevant to the execution of the order. The provision of the information in the Gentletrip Account or on the Gentletrip e-commerce website shall be deemed to constitute adequate notification. Where the Buyer's order has already been accepted for execution, the Buyer shall be informed of the suspension or termination of the Gentletrip functions relevant for the execution of this order by one of the contact details provided by the Buyer (by telephone, by text message or by e-mail).
- The Seller undertakes to deliver the goods ordered by the Buyer and to accept the Buyer's return of the goods, subject to the terms and conditions set out in the Conditions.
- In exceptional cases, under objectively justified circumstances beyond the Seller's foreseeable and controllable control, delivery of the goods may be delayed or made impossible. In such a case, the Seller undertakes to contact the Buyer immediately in order to determine the possibilities of further execution of his order.
- If the Seller disagrees with the Buyer's claims, the Seller shall provide the Buyer with a detailed reasoned written reply within 14 (fourteen) calendar days from the date of receipt of the Buyer's request, unless otherwise provided for by the laws of the Republic of Lithuania and the European Union.
- The Seller undertakes to fulfil other obligations imposed on the Seller by the Rules and the legislation of the Republic of Lithuania.
- Prices, payment procedures and terms
- The prices of goods on Gentletrip are quoted in euros, including VAT and other taxes, if any, in force at the time in accordance with the law.
- The Buyer may pay for the ordered goods by one of the following methods (the choice may be limited, so the final list of payment methods applicable to the respective order is specified in the respective order):
- using online banking;
- in the other ways indicated on the Gentletrip website
- When the Seller receives payment for the Goods, the order is confirmed.
- By accepting the Terms and Conditions, the Buyer agrees that the documents of purchase of the Goods, i.e. the VAT invoices, which are also the documents of guarantee applicable to the Goods, may be provided to the Buyer physically together with the Goods, or electronically at the e-mail address specified in the Buyer's registration form immediately after the order has been completed. The VAT invoices shall contain the details of the Seller, the goods selected, the quantity of the goods, the discounts to be granted, the final price of the goods, including all taxes, and any other data required to be provided in accordance with the legislation governing accounting records.
- VAT invoices for goods purchased by the Buyer may also be placed in the Buyer's Gentletrip Account. Once the Buyer has placed an order, the Buyer will be able to see the order sheet - the pre-paid invoice.
- The price of the Goods may change after the Seller has confirmed the order only in exceptional cases due to objective material reasons beyond the Seller's control (subject to proof of such reasons). If the reasons for the price change are justified and in such case the Buyer does not agree to purchase the Goods at the new price, the Buyer may cancel the order by informing the Seller via Gentletrip within 2 (two) working days at the contacts indicated on Gentletrip's e-commerce site. In the event of cancellation of an order in accordance with this clause, the Seller undertakes to refund to the Buyer all sums paid by the Buyer in respect of such cancelled order. The validity of the reasons for changing the price shall be assessed on a case by case basis.
- Delivery of the goods
- When ordering goods, the Buyer may choose one of the delivery methods listed in the Seller's specific offer for the goods sold.
- If the Buyer chooses a home delivery service at the time of ordering:
- The Buyer undertakes to specify the exact place of delivery.
- The Buyer undertakes to accept the goods himself. A valid proof of identity (ID card, passport or new driving licence) must be presented at the time of acceptance. If the Buyer does not collect the goods himself, although the goods have been delivered to the address indicated by the Buyer, the Seller shall be entitled to hand over the goods to another person at the address indicated by the Buyer and the Buyer shall not have the right to claim from the Seller for the delivery of the goods to the wrong person.
- Goods shall be delivered by the Seller or its authorised representative.
- If the Buyer chooses to collect the goods from one of the Lithuanian Post Offices at the time of order:
- The buyer can collect the goods from one of the Lithuanian Post offices by paying the specified redemption fee. If the Buyer fails to pay the above fee, the goods will be returned to the Seller.
- The ordered goods must be collected no later than 3 (three) working days after the courier has informed the Buyer by e-mail or SMS that the goods can be collected.
- Goods may be collected by a person other than the recipient specified in the order, as well as the person specified at the time of placing the order. When collecting the goods, it is necessary to have a valid identity document (ID card, passport or a new driving licence) with you and present it to the employee of Lithuania Post.
- If the Buyer chooses to have the Goods delivered to an Omniva post office, DPD or LP EXPRESS parcel self-service terminal at the time of placing the order:
- Goods weighing less than 30 kg can be collected from Omniva post offices or LP EXPRESS self-service terminals. Goods heavier than 30 kg are not delivered to post offices or parcel self-service terminals.
- The parcel must be collected from the Omniva post office within 7 (seven) calendar days after the Seller has informed the Buyer by e-mail that the goods are available for collection. The parcel must be collected from the LP EXPRESS parcel self-service terminal within 5 (five) calendar days after the courier has informed the Buyer that the goods are available for collection.
- The terms of delivery and the fee applicable to the Buyer are described HERE.
- In exceptional cases, the delivery of the goods may be delayed due to unforeseeable circumstances beyond the Seller's control and not reasonably foreseeable by the Seller at the time of the conclusion of the contract of purchase and sale. In such a case, the Seller undertakes to contact the Buyer immediately to agree on the terms and conditions for delivery of the goods.
- The Seller shall be exempted from liability for breach of the time limits for the delivery of the Goods if the Goods are not delivered to the Buyer, or are not delivered on time, due to the fault of third parties who are not related and/or independent of the Seller, or due to circumstances beyond the Buyer's control.
- At the time of delivery of the Goods to the Buyer, the Buyer shall inspect the condition of the consignment and the Good(s) together with the courier or his authorised representative and sign the delivery and acceptance document. Once the Buyer has signed the delivery and acceptance document, the Goods shall be deemed to have been delivered in good condition, free from any defects not attributable to manufacturing defects and free from any inconsistencies in the composition of the Goods(s) (such as can be detected by an external inspection of the Goods). If the Buyer notices that the packaging of the delivered goods is damaged (crumpled, wet or otherwise externally damaged), the goods(s) are damaged and/or the goods(s) are not in the right condition, the Buyer shall note this in the handover and acceptance document and in the presence of the courier. If the Buyer fails to do so, the Seller shall be exempt from liability in respect of damage to the Goods, where such damage is not due to a manufacturing defect, and in respect of non-conformity of the Goods, only if such non-conformity can be ascertained by an external inspection of the Goods.
- The risk of accidental loss or damage to the goods shall pass to the Buyer from the moment the goods are handed over to the Buyer.
- If, in accordance with Clauses 9.2 to 9.4 of the Regulations, the Buyer fails to collect the Goods within the time limit or fails to deliver them to the Buyer and the Buyer has paid for the Goods and their delivery, the Representatives shall contact the Buyer to arrange an alternative time and/or method of delivery. If the Buyer still does not collect the goods or fails to deliver them, such goods shall be returned to the Seller, the order shall be cancelled and the Buyer shall be refunded the money paid for the goods, less any bank charges applicable to the Seller for the bank transfers made and the delivery charge, if applicable.
- If, in accordance with Clauses 9.2 to 9.4 of the Regulations, the Buyer fails to collect the Goods within the time limit or fails to deliver the Goods to the Buyer, and the Buyer has not paid for the Goods, such Goods shall be returned to the Seller, and the order cancelled.
- Guarantee of the quality of the goods and shelf life
- The characteristics of each item sold by Gentletrip Seller shall be set out in the product description accompanying each item.
- The goods offered for purchase by the seller are of adequate quality. The goods are in conformity with the contract of sale for consumer purchase if:
- the product corresponds to the description given by the Seller and has the same characteristics as the product that the Seller has provided as a sample or model when advertising that product on Gentletrip;
- the product is suitable for the type of use for which this type of product is normally used;
- the goods meet the quality characteristics which are generally typical of goods of the same type and which the Buyer can reasonably expect from the nature of the goods and from the statements made publicly by the manufacturer of the item, its representative or the seller, including advertising and labelling of the items, as to the item's particular characteristics.
- The Seller shall not be liable for the fact that the size, shape, shade or other parameters of the goods sold by Gentletrip may not correspond to the actual size, shape, shade or other parameters of the goods due to the characteristics of the display used by the Buyer or other technical reasons beyond the control of the Seller. Photographs of the Goods are for illustrative purposes only and are exemplary. The shades, inscriptions, parameters, dimensions, sizes, functions and/or any other features of the original products may appear differently than in reality due to their visual characteristics, so please refer to the characteristics of the goods as indicated in the descriptions of the goods. The Buyer is advised to read the description of the product.
- The Seller offers a quality guarantee for different types of goods, valid for a certain period of time, the specific term and other conditions of which are set out in the descriptions of such goods or in the invoice accompanying the goods, which corresponds to the warranty card.
- The quality guarantee provided by the trader does not limit or restrict consumers' rights under the law in the event of a defective product or service.
- The Seller does not provide after-sales service (except for simple checks on the functioning of the goods that do not require specialised knowledge):
- if the centre(s) providing after-sales service is (are) located outside the Republic of Lithuania, the Seller shall arrange for the Goods to be sent to such centre(s);
- if the centre(s) providing after-sales service is/are located in the Republic of Lithuania, the Buyer shall be directed to such centre(s).
- Where the law prescribes a certain shelf life for particular goods, the Seller undertakes to sell such goods to the Buyer in such a way that the Buyer has a realistic opportunity to make use of them before the expiry of their shelf life.

- The Buyer shall have the right to withdraw from the distance purchase contract by notifying the Seller within 14 (fourteen) days without giving any reason. Please note that the Buyer may not exercise this right in the case of one of the contracts listed in Article 6.228(2)10 of the Civil Code of the Republic of Lithuania.
- Additional money-back guarantee by the seller:
- After a period of 14 (fourteen) but less than 30 (thirty) days from the date of delivery or collection of the goods, the Buyer shall be entitled to benefit from the Seller's additional money-back guarantee provided by Gentletrip to the Buyer, provided that all the returned goods are in the authentic labels, protective bags and original packaging, the disposable packaging of the goods is intact and the goods are not damaged, that is to say the goods do not have lost the same appearance as they were sold with.
- The Buyer must notify the Seller of its intention to make use of this guarantee (if applicable) within the time limit set by the Seller for such guarantee, calculated from the date of delivery of the goods to the Buyer. The notification shall be sent by email to hello@gentletrip.lt and must specify the goods to be returned.
- If the notification is made within 14 (fourteen) calendar days from the date of delivery of the Goods to the Buyer, the provisions of Clause 11.1 of the Conditions shall apply.
- If the notification is made after the expiry of the period of 14 (fourteen) calendar days, but no later than within the period of validity of the additional money-back guarantee set by the Seller from the date of delivery of the goods to the Buyer (if the Seller applies an additional money-back guarantee), the Buyer shall bear all the costs and risks associated with the return of the goods. In all cases, the Goods must be returned to the Seller by Gentletrip before the expiry of the period of such guarantee from the date of delivery or collection.
- The Buyer has the right to return the goods by sending them to the addresses indicated on Gentletrip's e-commerce website.
- The Seller's additional money-back guarantee cannot be used for the following items:
- Gentletrip gift vouchers;
- packaged goods that have been unpacked after delivery and are unsuitable for return for health or hygiene reasons;
- goods which have been made to the Buyer's individual order or are obviously tailored to the Buyer's needs, or which, by their nature, cannot be returned to the Buyer after they have been made available to the Buyer, due to a loss of merchantable qualities, or due to a perishable nature, or due to expiry;
- After exercising the rights set out in Clauses 11.1.-11.2 of the Rules for buying and selling goods in the 'Gentle Trip' e-shop, the Buyer shall be refunded: the price of the goods, the administrative fee, if applicable, and the cost of delivery of the goods (the cost of returning the goods is not refunded).
- If the Buyer has purchased a set of goods from Gentletrip, the Buyer must return the entire set of goods to the Seller, i.e. the Buyer may only exercise the rights provided for the return of the goods in respect of all the goods in the set.

- Procedures for replacing and returning faulty goods
- The defects of the sold goods shall be eliminated, the defective goods shall be replaced or returned in accordance with the procedure set out in the Rules and taking into account the requirements of the legislation of the Republic of Lithuania.
- If the Buyer has purchased goods of inadequate quality, the Buyer is entitled to one of the following remedies:
- the Seller to remedy the defects in the goods, free of charge, within a reasonable period of time if the defects can be remedied;
- to lower the purchase price accordingly;
- to have the goods replaced with goods of equivalent quality, unless the defects are minor or caused by the Buyer;
- refund the price paid and withdraw from the contract of sale in cases where the sale of goods of inferior quality constitutes a fundamental breach of the order.
- If the goods do not meet the quality requirements, the Buyer has the right to demand that the goods are of the correct quality, a proportionate reduction in the price of the goods, or to unilaterally terminate the contract of sale. In order to ensure the proper quality of the goods, the Buyer shall have the right to choose to require the goods to be repaired or to require their replacement, unless it would be impossible to meet the requirement or would cause the Seller to incur disproportionate costs in relation to the costs of meeting the other requirement, taking into account all the circumstances, including:
- the value of the goods if they were not defective;
- the significance of the defect (non-conformity);
- whether imposing a different requirement would cause any inconvenience to the Buyer.
- The buyer has the right to demand a proportionate reduction in the price of the goods or to terminate the contract of sale only if:
- the Seller has not repaired or replaced the goods, or the Seller has refused to cover the cost of returning the goods or the cost of removing and installing the goods when the goods have been properly installed (installed, furnished or fitted), or the Seller has refused to ensure that they are of the correct quality;
- the defect occurred despite the Seller's attempts to ensure the quality of the goods;
- the defect is fundamental;
- The Seller has stated or it is clear from the circumstances that it will not ensure the proper quality of the goods within a reasonable period of time or that this will cause serious inconvenience to the Buyer.
- The buyer does not have the right to cancel the contract if the defect is minor.
- In order to return the goods, the Buyer must comply with the following conditions:
- notify the Seller at the contact details on the invoice or by email to Gentletrip at hello@gentletrip.lt; the notification must specify the goods to be returned;
- proof of purchase of the goods and proof of guarantee (if issued);
- make a free-form application and submit it to the Seller.
- The Buyer may exercise the right to return goods of defective quality within the quality guarantee period set out in the document of purchase of the goods, as specified by the Seller. In the case of consumer purchases, the guarantee of the quality of the goods shall in all cases be at least 2 years from the date of receipt of the goods.
- The buyer must pay for the delivery costs and the costs of returning the goods. If the goods are returned for faulty quality, the Seller shall reimburse the Buyer for the costs of delivery and return.
- The money shall be refunded to the Buyer immediately, but not later than 5 days after the Seller has received the Buyer's notification of the defective quality of the Goods, and if the Goods have not been returned by the Buyer to the Seller, the time limit set out in this clause shall be calculated from the date of return of the Goods to the Seller. Money for the Goods shall be refunded to the Buyer in the same manner as the Buyer paid for the Goods at the time of purchase, unless the Buyer and the Seller agree otherwise. The Buyer shall in all cases have the right to request that the money be refunded to the bank account specified by the Buyer.
- Refunds are not available for goods that have been damaged intentionally or negligently (by chemicals, water, open flames, high temperatures, sharp objects, etc.), or if the rules for using or storing the goods have been violated, or if the goods have been used improperly or for other purposes.
- Separate rules for the return of the Seller's faulty goods may be set out in the warranty documents accompanying the goods. Such return policies of the Seller shall apply to the extent that they are not inconsistent with these Conditions. In the event of any inconsistency between these Conditions and the rules applied by the relevant Seller, these Conditions shall prevail.
- Replacement and return of goods if the wrong goods are delivered
- If the Buyer has been delivered the wrong goods, the Buyer must inform Gentletrip immediately, but no later than within 7 (seven) working days, by email to hello@gentletrip.lt. Upon being informed that the wrong goods have been delivered, the Seller undertakes to collect such goods and replace them with suitable goods. In the event that the Seller does not have the goods ordered, the Seller shall refund to the Buyer the money paid for the goods(s). The money shall be refunded to the Buyer immediately but not later than 5 days after the Seller has received the Buyer's notification that the wrong goods have been received, and if the Goods have not been returned by the Buyer to the Seller, the time limit set out in this clause shall be calculated as from the date of return of the Goods to the Seller.
- The procedure for returning goods and money is set out in Section 14 of the Rules.
- General rules on returning goods and money
- All gifts that accompanied the purchased goods must be returned at the same time as the return of the goods purchased by the Customer, unless the purchased goods are being returned due to a defect in the quality of the goods, and the gifts accompanying the goods have, by their nature, been consumed or have expired due to the nature of the gifts, within the period from the date of purchase of the goods to the date of discovery of the defect in such goods.
- When returning the goods, the Buyer must provide the sender's address and pack the goods properly so that they are not damaged during shipment. Goods are considered to be properly packaged when they are enclosed in additional outer packaging (in a box, a bag, wrapped in paper, etc.) and the packaging is tightly closed (e.g. sealed). If the returned goods are fragile or fragile, they must be further protected against impact by wrapping them in several layers of paper, cloth or bubble wrap and then placing them in the outer packaging of the parcel (box, bag, paper). The Seller shall not be liable for parcels sent by the Buyer with incorrect packaging or address, or if they are lost or damaged during their return to the Seller, except in the case of return by Gentletrip couriers.
- The Buyer may return the Goods to the Seller via courier. The Goods must be returned to the Seller at the address stated on the invoice provided by the Seller to the Buyer or www.gentletrip.lt.
- The money for the goods shall be refunded to the Buyer in the same way as the Buyer paid for the goods at the time of purchase, unless the Buyer and the Seller agree otherwise. The Buyer shall in all cases have the right to request that the money be refunded to the bank account specified by the Buyer.
- Responsibility
- The Buyer shall be liable for any unauthorised acts committed through the use of Gentletrip.
- Once registered, the Buyer is responsible for the storage and/or transfer of his/her login data to third parties. If a third party uses the services provided by Gentletrip by logging in to Gentletrip using the Buyer's login details, the Seller shall consider this person as the Buyer.
- The Seller shall be exempted from any liability in cases where the loss is caused by the Buyer's failure to read these Terms and Conditions, the Privacy Policy, the Terms of Use of www.gentletrip.lt despite having been given the opportunity to do so, despite the Seller's recommendations and obligations.
- If Gentletrip provides links to other third party websites, Gentletrip does not warrant that the information that can be accessed by clicking on these links (unless the Seller expressly states that clicking on a particular link provides access to the features and other information about the product being offered to the Customer) is correct, complete or accurate. The third parties are responsible for the content, truthfulness, completeness and accuracy of the information provided by third parties.
- Exchanges of information
- All communications relating to the purchase of goods through Gentletrip shall be made through Gentletrip, using the contacts provided on the Gentletrip e-commerce website.
- Gentletrip sends all notifications in accordance with these Terms and Conditions, the Terms and Conditions of Use of www.gentletrip.lt and the Privacy Policy to the e-mail address provided by the Buyer at the time of registration or when ordering the Goods, or by SMS to the telephone number provided by the Buyer.
- Concluding provisions
- These Rules are drawn up in accordance with the legislation of the Republic of Lithuania.
- The law of the Republic of Lithuania shall apply to relations arising under these Rules.
- Any disagreements arising from the application of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the legislation of the Republic of Lithuania.
- In case the Buyer does not agree with the Seller's response to the Buyer's written complaint, the Buyer (natural person, consumer) may submit his/her request/complaint regarding the goods purchased from the Seller (Gentletrip) to the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, tel. 85 262 67 51, fax. (85) 279 1466, on the website www.vvtat.lt (as well as the territorial units of the State Consumer Rights Protection Service in the districts) - or by filling in the request form on the EGS platform https://ec.europa.eu/odr/.
